Terms of Service

Agreement

These Terms of Service (“Terms”) govern your access to and use of Instant Lead Alerts (“Service”), operated by Air Wing Web Design & SEO (“we,” “us”). By creating an account, requesting access, or using the Service, you agree to these Terms.

The Service

Instant Lead Alerts provides SMS (and related) lead and communication alerts as described on our website, including notifications when leads are received through supported connectors, spam/trust scoring, and alert history. Features may include early access or preview capabilities that are not yet generally available. The Service is designed to complement your CRM, forms, and phone workflow. It is not a full CRM, job management, scheduling, or invoicing system.

Accounts and eligibility

You must provide accurate account information and keep credentials secure. You are responsible for activity under your account and for ensuring your use complies with applicable laws, including marketing and telemarketing rules for any numbers you configure.

SMS delivery

We use third-party carriers and messaging providers to send texts. Delivery is not guaranteed and may be delayed or blocked by carriers, device settings, or network conditions. You are responsible for providing correct phone numbers and for any message/data rates charged by your wireless provider.

Lead data and spam scoring

You represent that you have the right to send lead data to the Service. Trust/spam scores are informational aids and may be imperfect. We do not guarantee that every spam lead will be flagged or that every flagged lead is spam. Leads are not silently deleted by the scoring system.

Acceptable use

You agree not to:

• Use the Service for unlawful, harmful, or abusive purposes
• Attempt to disrupt, reverse engineer, or abuse the Service or its APIs
• Send spam or illegal content through connected forms or integrations
• Use alert phones you do not control or lack permission to text

Fees and billing

Public pricing starts at $35 per month (Starter), with Growth and Pro tiers for higher included missed-call volume, as described on our Pricing page. Form and JobTread lead alerts are unlimited; missed-call events beyond the plan allowance may incur overage charges. Billing is handled via self-serve checkout and the customer portal when enabled for your account. Fees are non-refundable except where required by law. We may change pricing with notice for future billing periods.

Disclaimer

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT UNINTERRUPTED OR ERROR-FREE OPERATION, OR THAT YOU WILL NEVER MISS A LEAD.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE AND OUR SUPPLIERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, OR DATA, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM.

Termination

You may stop using the Service at any time. We may suspend or terminate access for violation of these Terms, non-payment, or risk to the Service or others. Provisions that by nature should survive (including liability limits) will survive termination.

Changes

We may update these Terms by posting a revised version with a new effective date. Continued use after changes become effective constitutes acceptance.
